Commercial Litigation

Trial-ready representation in high-stakes business disputes across Connecticut, New York, and federal courts.

Overview

Business disputes rarely arrive clean. A shareholder falling out is also a valuation problem, a tax problem, and often a family problem. A construction dispute is also a lien priority, insurance coverage, and cash-flow problem. Commercial litigation at Green & Sklarz is built for that reality — lawyers who try cases, but who also read balance sheets, tax returns, and operating agreements without needing a translator.

We appear in Connecticut state and federal courts and, through our New York-admitted attorneys, in New York state courts, the Southern and Eastern Districts of New York, and the Second Circuit. Matters are resolved at every stage — negotiation, mediation, arbitration, trial, and appeal.

FAQ

Common questions

When is it worth filing suit versus negotiating?+

That is the first analysis we run: exposure, likely recovery, timing, disruption, discovery risk, and what the counterparty realistically will and will not do. The answer is often not to sue — but the credible ability to file changes the negotiation.

Do you handle both plaintiff and defense work?+

Yes. The same discipline applies to both, and the perspective of having sat on both sides is part of the value.

Will my dispute end up in arbitration?+

If the contract requires it. Our lawyers try cases in AAA and JAMS forums as well as in court, and we advise on when to invoke arbitration clauses and when to challenge them.

What about appeals?+

Members of the firm are admitted to the Second Circuit and the U.S. Supreme Court and handle appellate work in Connecticut and New York courts.

How do you control litigation cost?+

Scoped budgets by phase, staffed leanly, with the senior lawyer on the pen for the pieces that matter. We say no to discovery that will not move the case.
